29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition: Employee(s) engaged in operating fork trucks at the plant located at 1057 S. 69 Highway, Pittsburg, Kansas were exposed to struck by hazards due to the following: (a) Fork truck #1793 had no functioning horn. (b) Fork truck #1793 had no labeling of control levers. (c) Fork truck #2484 had no labeling of control levers. (d) Fork truck #1828 had no labelling of control levers.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: (a) Employee(s) engaged in operating a rotating Drying Drum in the Molasses Plant located at 1057 S. 69 Highway, Pittsburg, Kansas were exposed to struck-by hazards due to no guarding on the west end of the Drying Drum. (b) Employee(s) engaged in operating a rotating Drying Drum in the Molasses Plant located at 1057 S. 69 Highway, Pittsburg, Kansas were exposed to struck-by hazards due the metal guarding screens not being secured in place. The metal guards can be easily removed, thus not providing an effective guarding system for a rotating Drying Drum.
