29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:     a) Fabspeed Motorsport - Powder Coat Room - On or about March 23, 2021, employees were required to wear half-face elastomeric respirators to protect them from inhalation hazards of dusts and Triglycidyl Isocyanurate (TGIC) while powder coating metal car parts.  The employer did not develop and implement a written respiratory protection program as required.   Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.  a) Fabspeed Motorsport - Powder Coat Room - On or about March 23, 2021, employees were required to wear half-face elastomeric respirators to protect them from inhalation hazards of dusts and Triglycidyl Isocyanurate (TGIC) while powder coating metal car parts. The employer permitted employees who had beards that interfered with the sealing surface of the facepiece and the employees' face.   Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR  1910.134(h)(2)(i):  Respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals or  were not packed or stored to prevent deformation of the facepiece and exhalation valve:    a) Fabspeed Motorsport - Production Floor - On or about March 23, 2021, employees were storing their half-face elastomeric respirators out in the open on the shop floor where they were subject to dust contaminants from other metal fabrication production areas.   Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.
