29 CFR 1910.1053(d)(4): The employer did not reassess exposures whenever a change in the production, process, control equipment, personnel, or work practices was reasonably expected to result in new or additional exposures at or above the action level, or when the employer had reason to believe that new or additional exposures at or above the action level have occurred: (a) On or about March 24, 2021 - Sampling performed on April 29, 2021 for two employees in the grinding building showed an 8-hr time-weighted average concentration of respirable crystalline silica of 44.61 micrograms per cubic meter (mcg/m3) of air and 47.39 mcg/m3. Sampling times were 400 and 477 minutes. It was believed that these exposures were a result of work practices not previously assessed.

29 CFR 1910.1053(i)(1)(i): The employer did not make medical surveillance available at no cost to each employee, and at a reasonable time and place, for each employee who has been occupationally exposed to respirable crystalline silica at or above the action level for 30 or more days per year: (a) On or about March 24, 2021- Employees sampled in the April 29, 2021 sampling event which showed results of 44.61 mcg/m3 and 47.39 mcg/m3 (above the action level of 25 mcg/m3 but less than the PEL of 50 mcg/m3 had not been enrolled in medical surveillance.
