29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): a) European Auto Parts Store LLC, at 5040 Brighten Blvd, Denver CO, 80216: On or before March 23, 2021, the employer did not ensure forklift operators were trained in operation of powered industrial trucks in that the operator was not trained in the use of the Hyster Model H90XMS, Ser # K005D2223X forklift prior to its use. This condition exposed the operator and employees to struck by hazards.

The operator did not fully lower the loaded forks when left unattended. This condition exposed employees to stuck-by hazards.
