29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) Hjelm's Body & Paint Shop, LLC, shop: On or about March 24, 2021 and at times prior, employees were exposed to respiratory hazards while performing spray operations wearing 3M Half Mask Elastomeric Respirators without having a medical evaluation to ensure the employee was medically able to wear the respirator.
