A safety and health program with policy, hazard assessment, and site work rules was not developed and/or implemented at this job site.    a) Jobsite located at 320-328 Newport Place, Exton, PA: The employer had not initiated, developed or implemented a safety and health program to include, but not limited to, identification and control of hazards, training and education, and work safety rules and procedures to enable employees to recognize and avoid unsafe conditions and hazards.   Condition was observed on or about March 22, 2021.

29 CFR 1926.503(a)(1): The employer did not train each employee who might be exposed to fall hazards to enable them to recognize fall hazards and the procedures to be followed in order to minimize these hazards:   a) Jobsite located at 320-328 Newport Place, Exton, PA: The employer did not provide an effective training program for employees performing roofing operations from a steep pitch residential roof, thereby exposing the employees to 20 foot fall hazards.  Condition was observed on or about March 22, 2021.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):   a) Jobsite located at 320-328 Newport Place, Exton, PA: The employer did not ensure that employees performing roofing work on a steep pitch residential roof were protected by a guardrail or other fall protection measures, thereby exposing employees to potential fall heights of 20 feet.   Condition was observed on or about March 22, 2021.   Smart Pro Quality Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1466163, citation number 1, item number 1 and was affirmed as a final order on 4/10/2020, with respect to a workplace located at 4028 Reading Crest Ave, Reading, PA.
