29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a) 1000 Page Ave, Lyndhurst, NJ 07071: An operator using masonry equipment in a quarry was monitored for 478 minutes and was exposed to continuous noise at 92.7 decibels averaged over 8-hours with zero exposure averaged for any unsampled time. The equivalent dose was 146.9% of OSHAs Permissible Exposure Limit for Noise, which is 90 decibels. The employer did not administer a hearing conservation program, thus exposing the employee to irreversible hearing loss, on or about March 23, 2021.  b) 1000 Page Ave, Lyndhurst, NJ 07071:  An operator using masonry equipment in a quarry was monitored 480 minutes and was exposed to continuous noise at 90.5 decibels averaged over 8-hours with zero exposure averaged for any unsampled time. The equivalent dose was 110% of OSHAs Permissible Exposure Limit for Noise, which is 90 decibels. The employer did not administer a hearing conservation program, thus exposing the employee to irreversible hearing loss, on or about March 23, 2021.

29 CFR  1910.134(c)(1)(viii): The written program did not contain provisions for training of employees in the proper use of respirators, including putting on and removing them, any limitations on their use, and their maintenance: (Construction Reference 1926.103)   1000 Page Ave, Lyndhurst, NJ 07071: Employees are required to wear half face elastomeric respirators for silica dust while operating masonry machinery to shift through recycled materials. Employees were not trained on the proper use of respirators, including any limitations on their use, and their maintenance on or about 23 March, 2021.
