29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section: At a worksite located at or near 55th Street and Stateline Road, Kansas City, MO: Employees were exposed to health hazards in the form of crystalline silica. This was demonstrated on or about March 26, 2021, when employees were exposed to respiratory hazards when employees were dry-cutting asphalt and concrete. Wet methods and/or vacuum collection systems were not in use. Employees were exposed to respiratory hazards from the accumulation of dust when the vacuums systems or wet methods were not utilized during the course of the project.

29 CFR 1926.1153(i)(2)(i): The employer did not ensure that employees covered by this section could demonstrate knowledge and understanding of at least the requirements outlined in 29 CFR 1926(i)(2)(i)(A) through (F) where there was exposure to respirable crystalline silica: At a worksite located at or near 55th Street and Stateline Road, Kansas City, MO: Employees were exposed to health hazards in the form of crystalline silica. This was demonstrated on or about March 26, 2021, when employees were exposed to respiratory hazards during dry-cutting asphalt and concrete. Not all employees at the worksite had been trained or were provided information on the respiratory hazards associated with exposure to crystalline silica.
