29 CFR OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to the hazard of falling from the back of a moving vehicle: (a) On or about March 17, 2021, employee was riding in the truck bed with the tailgate down on a 2002 Ford F150 without seatbelts or other safety restraints exposing him to a fall onto the paved alleyway while transporting buckets of soil and debris to the rear of the site. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
