29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) MM Construction at 1612 Legacy Drive, Brandon, SD 57005: On or about and and times prior to March 31, 2021, the exposing employer did not ensure that employees were protected from falls while conducting residential framing operations. The employee was installing floor sheathing on the first level of the residential home and was exposed to fall hazards associated with the leading edge and the exterior of the property. This condition exposed the employee to a fall hazard of over 10 feet.

29 CFR 1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a) MM Construction at 1612 Legacy Drive, Brandon, SD 57005: On or about and at times prior to March 31, 2021, the employer did not ensure that employees that were exposed to fall hazards were trained to recognize and minimize the hazards associated with working from heights prior to doing so. This condition exposed employees to fall hazards greater than 10 feet.
