1926.28: The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions. (a) On or about April 1, 2021, an employee working at or around the fourth floor east elevator shaft was not protected from falling to a lower level when standing on an elevated work platform next to the guardrail system while performing patchwork. This exposed the employee to a fall hazard .

29 CFR 1926.451(h)(2)(i): The area below the scaffold was not barricaded, and employees were not prohibited from entering the hazard area. (a) On or about March 31, 2021, in the area directly in front of and below the scaffold located on the East side exterior of the Jobsite, employees were allowed to walk and work in the area below and in front of the Scaffold . This exposed employees to struck by hazards.
