29 CFR OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to amputation hazards from the lack of an effective/detailed inspection program for PM presses: a.) Proform Powdered Metals, Inc. - On or about 3/23/21, and times prior thereto the company was allowing hand pulling of parts on sizing press 45b. An amputation occurred when an employee was hand pulling parts and the air failed causing the top ram and tooling to strike the employees hand. An effective detailed periodic inspection program was not developed for the presses. Deficiencies with the sizing press 45b included but was not limited to a defective brake monitor (stopping performance monitor) and a broken air fitting. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
