29 CFR  1903.19(c)(1): Within 10 calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section.  On or about 8/19/2021, the employer failed to certify to OSHA that the following hazards have been abated.   a) Throughout facility - On or about April 2, 2021, the employer did not provide effective information and training to employees working with hazardous chemicals at the facility. Employees who work with chemicals such as, but not limited to 4.2 VOC Polyurethane clearcoat, Reducer DT885, Reducer DT895 and Everglass body filler when painting and sanding the automobile parts were not protected from potential health and/or fire hazards.  b) Paint Shop -  On or about April 2, 2021, and at times prior, the employer exposed employees to respiratory tract irritations in that the employer failed to provide a medical evaluation to determine the employee's ability to use a respirator when employees were required to wear respirators everyday while painting automobile parts and working with chemicals such as, but not limited to 4.2 VOC Polyurethane clearcoat.  c) Sanding Department -  On or about April 2, 2021, and at times prior, the employer exposed employees to respiratory tract irritations in that the employer failed to provide the information contained in Appendix D of Respiratory Protection Program to employees wearing N95 particulate respirators voluntarily while sanding the automobile parts.
