OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of contracting the virus, SARS-CoV-2 (severe acute respiratory syndrome coronavirus 2), the cause of the COVID-19 disease. On or about March 3, 2021, and continuing thereafter, employees throughout the Londonderry, New Hampshire facility were exposed to the hazard of contracting the virus SARS-CoV-2, which causes the COVID-19 disease, while working in close contact with other employees who had no daily screening for COVID symptoms, did not wear face coverings, and were not informed of their potential exposure after working near someone who tested positive for COVID-19 and thereafter encouraged to quarantine. Additionally, high-touch surface areas, including the office, breakroom, and trucks, were not thoroughly cleaned and disinfected. Between March 3, 2021, and March 24, 2021, four employees tested positive for COVID-19.

29 CFR 1904.4(a): The employer did not record each work-related fatality, injury or illness case that resulted in the general recording criteria on the OSHA Form 300 or equivalent. On or about April 1, 2021, the employer did not record the following workplace illnesses on the OSHA-300 log or its equivalent: From the time period between March 9, 2021, and March 24, 2021, three cases of COVID-19 infection which resulted in 7 to 27 days away from work.
