29 CFR  1903.19(c)(1): Within 10 calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section.   On or about 8/24/2021, the employer failed to certify to OSHA that the following hazards have been abated.  (a) Mixing Area: On or about 3/31/2021 and at times prior, the employees were exposed to chemical hazards, in that a written hazard communication program was not implemented when employees were handling hazardous chemicals such as MBB containing portland cement while mixing.  b) Mixing Area: On or about 3/31/2021 and at times prior, employees were exposed to chemical hazards, in that copies of safety data sheets were not readily accessible when employees were mixing MBB which contains portland cement.   c) Mixing Area: On or about 3/31/2021 and at times prior, the employees were exposed to chemical hazards, in that training, which would include an explanation of the safety data sheet was not provided to employees who were required to mix hazardous chemicals such as MBB which contains portland cement.  d) Mixing Area: On or about 3/31/2021, and at times prior, the employer exposed employees to respiratory hazards, in that Appendix D information was not provided to employees using N95 respirators while performing tasks such as mixing MBB which contains portland cement.
