29 CFR 1926.600(a)(6)(i): For lines rated 50 kV or below, minimum clearance between the lines and any part of the load was not maintained at 10 feet; (a) Lander Waste Water Treatment Facility: On or about March 29, 2021, and at times prior thereto; the employer did not ensure employees were protected from the potential of electrocution. Employees hoisted a 16' h x 18' w Aluma beam with a JCB 509-42 Forklift when the forks made contact with the overhead primary and secondary power lines operating up to 12,470 volts.

29 CFR 1926.600(a)(6)(iv): A person was not designated to observe clearance of the equipment and give timely warning for all operations where it is difficult for the operator to maintain the desired clearance by visual means: (a) Lander Waste Water Treatment Facility: On or about March 29, 2021 and at times prior thereto; the employer did not specifically assign an observer to be positioned so as to be able to visually monitor the clearance between the JCB 509-42 Forklift and the overhead primary and secondary power lines. Lines were operating up to 12,470 volts.
