OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of contracting the virus, SARS-CoV-2 (severe acute respiratory syndrome coronavirus 2), the cause of the COVID-19 disease. On or about March 20, 2021 and continuing thereafter, employees working throughout the facility were exposed to the hazard of contracting COVID-19 while working in close contact with other employees. Employees were not informed of their potential exposure after working near someone who tested positive for COVID-19. This exposed employees to the hazard of contracting COVID-19 from other employees in the facility. Among other methods, feasible and acceptable methods to abate this hazard include: 1. Develop a written COVID plan in place of verbal plans and policies. Update and ensure continuous enforcement of the employer?s verbal COVID-19 plan in accordance with applicable CDC guidelines. 2. Use contact tracing to ensure that employees who have worked near someone who tested positive for COVID- 19 and/or developed symptoms of COVID-19 are informed of their potential exposure to the virus. This should be done as soon as possible after the employer is notified that employees have tested positive for COVID-19.?

Location: 32 Northwestern Drive in Salem New Hampshire: On or about April 27, 2021, the employer did not record six instances among other instances, of employee work-related COVID-19 infections on the OSHA 300 log or its equivalent, for the time period between March 24, 2021 and April 6, 2021, with lost work days ranging from 10 to 90 days.

If your establishment had 20 or more employees but fewer than 250 employees at any time during the previous calendar year, and your establishment is classified in an industry listed in appendix A to subpart E of this part, then you must electronically submit information from OSHA Form 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee. You must submit the information once a year, no later than the date listed in paragraph (c) of this section of the year after the calendar year covered by the form. Location: DataEd at 32 Northwestern Drive in Salem New Hampshire: On or about April 5, 2021, the employer failed during calendar year 2020, to electronically submit information from their OSHA Form 300A or equivalent by March 2, 2021. a).
