29 CFR  1910.134(e)(1):  The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a) Unit North One, 99 Mulford Road, Lafayette, NJ, 07848.   On or about 5/6/2021 to 5/15/2021, the employer did not provide a medical evaluation to determine each employee's ability to use a respirator before requiring the use. The employer required temporary LPNs, CNAs, and TNAs to wear respirators while providing care to suspected and confirmed positive COVID-19 residents.  Violation occurred from 5/6/2021 to 5/15/2021.  The Andover Subacute and Rehab Center II was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1910.134(e)(1)), which was contained in OSHA inspection number 1472602, citation number 1, item number 1c  and was affirmed as a final order on 11/9/2020, with respect to a workplace located at 99 Mulford Road, Lafayette, NJ, 07848.

29 CFR  1910.134(f)(2):  The employer shall ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter.  a) Unit North One, 99 Mulford Road, Lafayette, NJ, 07848.  On or about 5/6/2021 to 5/15/2021, the employer did not provide a fit test to all temporary employees required to wear respirators. The employer required temporary LPNs, CNAs, and TNAs to wear N95 filtering facepiece respirators to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed positive COVID-19 residents.  Violation occurred from 5/6/2021 to 5/15/2021.  The Andover Subacute and Rehab Center II was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1910.134(f)(2)), which was contained in OSHA inspection number 1472602, citation number 1, item number 1d and was affirmed as a final order on 11/9/2020, with respect to a workplace located at 99 Mulford Road, Lafayette, NJ, 07848.

29 CFR 1910.134(k)(1):  The employer did not provide effective training that covered the required elements in 1910.134(k)(1)(i) - (vii):  a) Unit North One, 99 Mulford Road, Lafayette, NJ, 07848.  On or about 5/6/2021 to 5/15/2021, the employer did not provide temporary LPNs, CNAs, and TNAs with effective training including, but not limited to, the effects of improper fit, limitations of respiratory protection, proper respirator maintenance and care, medical signs and symptoms preventing effective use, and seal check of filtering facepiece respirators. The employer required temporary employees to wear N95 filtering facepiece respirators to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed positive COVID-19 residents.  Violation occurred from 5/6/2021 to 5/15/2021.
