29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a) On April 7, 2021, Generations at Regency, LLC did not provide a medical evaluation to determine the employee's ability to use a respirator.  Nurses and CNAs entered the rooms of COVID positive residents and PUIs in the COVID Unit to provide patient care and were required to wear respiratory protection, including a N95 respirator.    No abatement certification or documentation is required for this item.

29 CFR  1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator:  a) On April 7, 2021, Generations at Regency, LLC did not ensure that employees required to use tight-fitting facepiece respirators were fit tested prior to initial use of the respirator. Nurses and CNAs entered the rooms of COVID positive residents and PUIs in the COVID Unit to provide patient care and were required to wear respiratory protection, including a N95 respirator.    No abatement certification or documentation is required for this item.

29 CFR  1904.41(a)(2): 29 CFR 1904.41(a)(2):  The establishment had 20 or more but fewer than 250 employees at any time during the previous calendar year, and the establishment was classified as an industry listed in appendix A to subpart E of this part, but did not electronically submit information from OSHA 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee.  The employer did not submit the information once a year, no later than the date listed in paragraph (c) of this section of the year after the calendar year covered by the form:  a) On April 7, 2021, Generations at Regency, LLC failed during calendar year 2020, to electronically submit information from their OSHA Form 300A or equivalent by March 2, 2021. The establishment employed 184 employees and was classified with NAICS 623110 during calendar year 2020.  No abatement certification or documentation is required for this item.
