29 CFR 1926.602(d):  The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):  29 CFR 1910.178(l)(1)(i):  The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a)  On or about April 7, 2021, the employer provided employees with a Lull 1044C-54 rough terrain forklift without ensuring they were competent to operate the equipment safely, as demonstrated by successful completion of forklift training and evaluation.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.451(e)(1):  Portable ladder, hook-on ladder, attachable ladder, stair tower, stairway-type ladder, ramp, runway, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used to access scaffold platforms more than 2 feet above or below a point of access:   a)  On April 7, 2021, employees were exposed to a fall hazards while accessing and egressing the work platform of a frame scaffold.
