29 CFR  1910.134(c)(2)(ii):The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:  a) Top Pick Shed - On or about March 31, 2021, an employee voluntarily used a half-face tight fitting respirator when grinding, a written program was not established to ensure medical fitness and proper maintenance. This condition exposed the employee to physiological and respiratory hazards.

29 CFR  1910.134(k)(6):The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  a) Top Pick Shed - On or about March 31, 2021, an employee voluntarily wore a half-face tight fitted respirator when performing grinding operations, and was not provided Appendix D of the respiratory standard, exposing the employee to chemical and respiratory hazards.

29 CFR  1910.1200(f)(6): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier, signal word, hazard statement(s), pictogram(s), precautionary statement(s) and name, address, and telephone number of the chemical manufacturer, importer, or other responsible party.  a)  Powerhouse/Engine Room - On or about March 31, 2021, employees used a clear liquid for generators, but the container was not labeled as to its contents, exposing employees to chemical hazards.  b) Fabrication Shop - On or about March 31, 2021, employees transferred chemicals including, but not limited to Skyco Ospho Rust Treatment, simple green, glass cleaner, and tire cleaner into secondary containers.  The containers were not labeled to identify its contents, exposing employees to chemical hazards.
