Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a) SB Cruz Construction, at a jobsite located at 2197 Whitehill Drive, Lot 2608, Delaware, Ohio 43015: On and/or preceding April 7, 2021, the employer did not ensure employees were protected from falls while engaged in residential construction activities. An employee was working from the front porch roof. The employee was not protected from falls by any means, thereby exposed to a 12 foot fall hazard.

Employees were working from an the elevated scaffold platform of a pump jack scaffold where the poles were placed on scrap pieces of OSB and lumber, thereby being exposed to fall hazards of up to 23 feet.

29 CFR 1926.451(g)(1):Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. a) SB Cruz Construction, at a jobsite located at 2197 Whitehill Drive, Lot 2608, Delaware, Ohio 43015: On and/or preceding April 7, 2021, the employer did not ensure that employees engaged in work from a pump jack scaffold were protected from falls to a lower level. Employees were installing trim and siding to the second story while working from pump jack scaffolds without safety nets installed, safety nets correctly installed, or end rails installed, which exposed them to falls up to 23 feet.
