29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck safely:  a.  On or about April 7, 2021 at the above address, an employee was required to operate a powered industrial vehicle and had not been provided with training, including but not limited to formal instruction, practical training and an evaluation of the operators performance, thereby exposing employees to struck by and crushing hazards.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a.  On or about April 7, 2021, at the above addressed jobsite, an employee removing wood studs from a Powered Industrial Vehicle (PIV), approximately twenty-four (24) feet seven (7) inches above the ground, was not protected from falls, thereby exposing the employee to fall hazards.  Van Buren Builders, Inc. was previously cited for a violation of this occupational safety and health standard  1926.501(b)(13), which was contained in OSHA inspection number 1211769, citation number 1, item number 1 and was affirmed as a final order on May 2, 2017, with respect to a workplace located at Lot 34 Prairie Ridge, New Lenox, IL 60451.

29 CFR 1926.503(b)(1):The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  a. On or about April 7, 2021, at the above addressed jobsite, employees had been provided fall protection training, however, the employer failed to keep a written certification of record.
