OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught-in-between hazards due to  vehicle operations and servicing activities:   (a)Agtegra Cooperative at 38565 142nd Street, Warner, SD 57479:  On or about and at times prior to April 7, 2021, the employer did not ensure that an employee performing maintenance operations on a semi-trailer was protected from a caught-in-between hazard associated with vehicle movement. The employer did not have sufficient procedures and controls implemented to effectively ensure that vehicles were de-energized before employees initiated the process of performing maintenance activities.  This condition exposed an employee to a caught-in-between hazard associated with movement of a vehicle.  Among other methods, one feasible and acceptable method to correct this hazard is to develop and implement specific procedural elements to control hazardous energy in accordance with the American National Standards Institute (ANSI)-American Society of Safety Engineers (ASSE) Z244.1-2003 publication.
