29 CFR 1926.20(b)(1): The employer did not initiate and maintain such programs as may be necessary to comply with this part: On or about 04/03/2021, at 3420 40th Avenue SE Naples, FL 34120, the employer did not implement an accident prevention program at the site where employees were exposed to fall and struck-by hazards. The employer did not inspect a concrete structure and failed to instruct/prohibit an employee from placing a ladder against a section of concrete that was not capable of supporting the load.

29 CFR 1926.701(a): No construction loads shall be placed on a concrete structure or portion of a concrete structure unless the employer determines, based on information received from a person who is qualified in structural design, that the structure or portion of the structure is capable of supporting the loads: On or about 04/03/2021, at 3420 40th Avenue SE Naples, FL 34120, an employee was exposed to fall and struck by hazards when using a concrete structure to support an extension ladder, in that, the employer did not ensure that a load-bearing determination for the structure was made by a qualified person, prior to allowing the employee to place a load on the wall.
