29 CFR  1926.451(g)(1):Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  On or about April 9, 2021, located on the north side of a commercial exterior structure, employees were exposed to a fall hazard while working from improvised wooden scaffolds without fall protection. Potential fall height was measured to be approximately twelve (12) feet.

29 CFR  1926.454(a):The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  The employer did not ensure that employees had received training on hazard recognition and procedures for controlling or minimizing hazards associated with scaffolds.

29 CFR  1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  Located on the north side of a commercial structure, employees were exposed to a fall hazard of approximately eleven (11) feet while installing house wrap and not utilizing any fall protection system.

29 CFR  1926.503(b)(1): The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.   On or about April 9, 2021, located at 281 Trace Colony Park Drive in Ridgeland, MS, the employer did not maintain certification records for fall protection training.

29 CFR  1926.503(c): When the employer has reason to believe that any affected employee who has already been trained does not have the understanding and skill required by paragraph (a) of this section, the employer is to retrain each such employee such as inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding of skill.   On or about April 9, 2021, located on the north side of a commercial structure, an employee was exposed to a fall hazard while installing house wrap while not utilizing an adequate fall protection system.   Potential fall height measured to be approximately 11 feet above the ground below.
