OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to potential fire hazards associated with the ventilation control and fire protection of commercial frying operations: a) Terelly, Inc. dba Clark's Donuts Plus, on or about April 9th, 2021 and times prior thereto, employees were exposed to potential fire hazards in that: 1) Gaps/openings were present in the Aerolator Systems, Inc. exhaust hood (Model ACW-8554), due to the improper arrangement of grease fitlers/baffles, which allowed air to be exhausted without passing through grease filters/baffles. Accumulations of grease buildup were found within the exhaust ventilation system. 2) The exhaust system associated with the Aerolator systems, Inc. exhaust hood was not being inspected semiannually and cleaned, as required, in accordance with NFPA 96 Standard for Ventilation Control and Fire Protection of Commercial Cooking Operations, section 12.6. Accumulations of grease buildup were found within the exhaust ventilation system. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation. This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.

The employer did not have a written hazard communication program. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). Terelly, Inc. dba Clark's Donuts Plus, on or about April 9th, 2021 and times prior thereto: Employees worked with and around hazardous substances including, but not limited to, Member's Mark Floor Cleaner and Degreaser, and Betco brand Simplicity Sanibet Multi-Range disinfectant. The employer did not provide hazard communication training for all employees who worked with and around hazardous substances.
