Rudy Steury dba Rudy Steury, 4758 Thoroughbred Loop, Erie, PA  16506, on or about April 14, 2021 and times prior thereto:  Employees were using chemicals including, but not limited to, gasoline.  The employer did not have a written hazard communication program.

Rudy Steury dba Rudy Steury, 4758 Thoroughbred Loop, Erie, PA  16506, on or about April 14, 2021 and times prior thereto:  Employees were using chemicals including, but not limited to, gasoline.  Safety data sheets were not on-site and available to employees. 29 CFR 1926.403(b)(2):  Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification:  A.)  Rudy Steury dba Rudy Steury, 4758 Thoroughbred Loop, Erie, PA  16506, on or about April 14, 2021 and times prior thereto:  Employees were utilizing a DeWalt 12-inch Double Bevel Sliding Compound Miter Saw (M/N:  DWS779, S/N:  420090) to cut lumber.  The miter saw was power via a flexible cord that was plugged into a receptacle within a metal electrical knockout box.  The metal electrical knockout box which housed the receptacle was on the ground and the receptacle was wired into a flexible cord that was plugged into the GFCI receptacle at the temporary service.  The use of the metal electrical knockout box was not listed and labelled for this purpose and were used in construction environments for portable applications.  ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  A.)  Rudy Steury dba Rudy Steury, 4758 Thoroughbred Loop, Erie, PA  16506, on or about April 9, 2021 and times prior thereto:  Employees were exposed to a fall hazard of 9.4-feet through a floor opening from the first floor into basement.  On or about April 9, 2021, an employee fell through the floor opening.  Employees were not utilizing means or methods of fall protection when exposed to the floor opening, nor were guardrail systems or secured floor hole covers in place.  B.)  Rudy Steury dba Rudy Steury, 4758 Thoroughbred Loop, Erie, PA  16506, front/south exterior wall, center opening above main entry doorway opening, on or about April 9, 2021 and times prior thereto:  Employees were exposed to a fall height of 13.5-feet through the second floor exterior wall to the ground below.  The wall opening was not equipped with a top rail.  C.)  Rudy Steury dba Rudy Steury, 4758 Thoroughbred Loop, Erie, PA  16506, front/south exterior wall, right opening above garage door opening, on or about April 9, 2021 and times prior thereto:  Employees were exposed to a fall height of 13.1-feet through the second floor exterior wall to the ground below.  The wall opening was not equipped with a top rail.  ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation.  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
