29 CFR 1926.451(c)(1): Supported scaffolds with a height to base width (including outrigger supports, if used) ratio of more than four to one (4:1) were not restrained from tipping by guying, tying, bracing, or equivalent means, as set forth in subparagraphs (i) - (iii) of this paragraph. Location: a) Mobile scaffold on the ground level of the jobsite: On or about April 7, 2021, employees were installing LED lights on an approximately 12 feet tall by 2 feet wide mobile scaffold. The scaffold was height to base width ratio was more than four to one and was not restrained from tipping.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Scaffold frames were used as a means of access. Location: a) Mobile scaffold on the ground level of the jobsite: On or about April 7, 2021, employees were installing LED lights on the second tier of a mobile scaffold. They accessed the platform by climbing up the rungs of the scaffold. The rungs were not designed as means of access. The employee was exposed to falling up to approximately 9 feet to the lower level.

29 CFR 1926.454(a):The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. Location: a) Mobile scaffold on the ground level of the jobsite: On or about April 7, 2021, employees were installing LED lights on the second tier of a mobile scaffold. The platform was not restrained from tipping, and the employees did not have a safe means of access to the scaffold platform. The employees were exposed to falling approximately 9 feet from the second tier platform to the ground level and were not trained about hazards of the scaffold.
