29 CFR  1926.501(b)(11):Each employee on a steep roof with unprotected sides and edges 6 feet or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:   a. Main Building - Workers on-site performing roofing work were exposed to falls of between 17 feet 5 inches at the roofs eave and 22 feet 7 inches at the roofs peak, when fall protection equipment was not installed and/or utilized.  b. Auxiliary Building - Workers on-site performing roofing work were exposed to falls of between 13 feet 1 inches at the roofs eave and 19 feet 1 inches at the roofs peak, when fall protection equipment was not installed and/or utilized.     OSHA and Adam Vaillancourt Citation and Settlement History:   Adam Vaillancourt Roof and Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.21(b)(2), which was contained in OSHA inspection number 1004557, citation number 001, item number 001, and was affirmed as a final order on 12/15/2014, with respect to a workplace located at 340 Nashua St. Milford, NH 03055.  The Informal Settlement Agreement stated "Employees and workers under the control of the employer were exposed to a fall of 24 feet while working on the roof where adequate instruction and avoidance of these conditions were not communicated."    Adam Vaillancourt LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29CFR 1926.501(b)(13), which was contained in OSHA inspection number 1222744, citation number 001, item number 003 and was affirmed as a final order on 6/1/2017, with respect to a workplace located at 517 Pine St. Manchester, NH 03101.   Adam Vaillancourt LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.503(a)(1), which was contained in OSHA inspection number 1309685, citation number 001, item number 001, and was affirmed as a final order on 10/29/2018, with respect to a workplace located at 73 E. Broadway in Derry, NH 03038.  Citation 1 Item 1 states "Site - On or about April 18, 2018, an employee was exposed to a fall hazard greater than 15 feet from a roof where an adequate training program that would enable them to recognize the hazards associated with falls was not provided."  The Informal Settlement Agreement for OSHA inspection 1309685 required that Adam Vaillancourt, LLC "�develop a site specific fall protection plan for work occurring on future jobsites to protect against injuries for work occurring at elevated locations for both employees and subcontractors."    Note: Since 2014, OSHA has issued 10 fall protection related violations (27 total violations including 2 Repeats) to subcontractors of Adam Vaillancourt Roofing and Construction, LLC, on jobsites where Adam Vaillancourt Roofing and Construction, LLC was the controlling employer and also received citations. The inspection numbers with respect to Adam Vaillancourt Roofing and Construction, LLC were 1309685, 1222744, and 1004557. In this OSHA Inspection (1524546), subcontractor employees were again working unprotected while Adam Vaillancourt Roofing and Construction, LLC management observed, oversaw, and failed to correct their unsafe work practices on multiple occasions. On this jobsite (253 Sheep Davis Road, Concord, NH), the employer was not adhering to the previously agreed upon the terms of the OSHA Inspection 1309685 Informal Settlement Agreement where a specific fall protection plan was not developed and utilized.
