29 CFR 1910.178(l)(1)(i):The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): (a) DE-KOR by Mile High Balusters, Inc. dba DEKOR, at 2655 S. Santa Fe Drive, Unit 4A, Denver, CO 80223: On and before April 13, 2021, the employer did not ensure all forklift operators were trained in the operation of powered industrial trucks, in that the operators were not trained in the use of the Clark COC25 forklift prior to its use. This condition exposed the employees to hazards of improper forklift operation which include amputation, laceration, and other serious bodily harm.

29 CFR 1910.178(q)(7):Industrial trucks were not examined before being placed in service: (a) DE-KOR by Mile High Balusters, Inc. dba DEKOR, at 2655 S. Santa Fe Drive, Unit 4A, Denver, CO 80223: On and before April 13, 2021, the employer did not ensure the powered industrial trucks were examined daily before being placed in service. Daily examinations were not conducted by employees that operated the Clark COC25 Powered Industrial Truck. This condition exposed the employees to the hazard of operating forklifts without proper inspections which include amputation, laceration, and other serious bodily harm.
