OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards.   a)Final Assembly Station - 820 Bloomfield Ave. Clifton NJ: Employees were pressure testing non-ferrous casted boxes where one employee was transported to the hospital after being struck in his stomach by a piece of the non ferrous cast box while engaged in  the pressure testing operation  utilizing compressed Nitrogen, on or about 4/13/21.

29 CFR  1910.101(b):The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tankcars, or motor vehicle cargo tanks were not in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in CFR 1910.6:  a) Final Assembly Station - 820 Bloomfield Ave,  Clifton NJ :  Compressed Nitrogen gas was not handled by experienced and properly trained employees, including Director of Operations - Machine Shop, Machine Shop Engineer and Assembly Area Lead, on or about 4/13/21.  b) Final Assembly Station - 820 Bloomfield Ave,  Clifton NJ: A regulator that could not regulate the pressure to a safe level was not used as Nitrogen gas at approximately 2000psi was admitted to a non-ferrous casted battery enclosure that blew up during the first pressure testing, on or about 4/13/21.

29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated, the person certifying that the evaluation has been performed, the date(s) of the hazard assessment, and, which identifies the document as a certification of hazard assessment:  a)Final Assembly Station - 820 Bloomfield Ave, Clifton NJ: An employee sustained blunt Trauma Force to his stomach area during a pressure test which resulted in an explosion and one piece struck the employee. The employer provided Personal Protective Equipment for employees that were performing a pressure test utilizing a Nitrogen Cylinder, however the employer did not verify that the required workplace hazard assessment had been performed through a written certification that identifies the workplace evaluated, the person certifying that the evaluation had been performed, and the date of the hazard assessment, on or about 4/13/21.

29 CFR 1910.1200(h)(1): Employers did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets.  a) Final Assembly Station - 820 Bloomfield Ave, Clifton NJ: Employees were testing a non-ferrous casted battery enclosure with Compressed Nitrogen from a Cylinder. The box exploded and struck a worker who was transported to the hospital and sustained blunt force trauma. The employees involved in the testing operation had not been given the Nitrogen SDS and had not been trained in the recognition of the hazards associated with this compressed gas. The Nitrogen SDS was not in the company binder with the other SDS'. Effective Hazard Communication training was not provided to the employees engaged in the pressure testing of a non-ferrous casted battery enclosure, on or about 4/13/21.
