29 CFR  1926.451(b)(1):Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports.  a) 2nd level: On or about April 13, 2021 and times prior, employees used a  fabricated frame scaffold to pressure wash and paint the wood paneling on a multi-story residential home. Each platform of the scaffold was only equipped with one plank exposing employees to falls up to 16 feet.  b) 3rd level: On or about April 13, 2021 and times prior, employees used a  fabricated frame scaffold to pressure wash and paint the wood paneling on a multi-story residential home. Each platform of the scaffold was only equipped with one plank exposing employees to falls up to 24 feet.  c)4th level: On or about April 13, 2021 and times prior, employees used a  fabricated frame scaffold to pressure wash and paint the wood paneling on a multi-story residential home. Each platform of the scaffold was only equipped with one plank exposing employees to falls up to 32 feet.  d) 5th level: On or about April 13, 2021 and times prior, employees used a  fabricated frame scaffold to pressure wash and paint the wood paneling on a multi-story residential home. Each platform of the scaffold was only equipped with one plank exposing employees to falls up to 40 feet.

29 CFR  1926.451(b)(2):Scaffold platforms and walkways were not at least 18 inches wide.  a) Wooden walkway: On or about April 13, 2021 and time prior, and employee used a wooden walkway to access scaffold sections.  The walkway was approximately 8 inches wide exposing employees to a fall of approximately 40 feet.   b)Bottom Werner walkway: On or about April 13, 2021 and times prior, employees used a metal platform to work from and travel to separate scaffold tiers.  The metal platform was approximately 12 inches wide exposing employees to a fall of approximately 12 feet.   c)Middle Werner walkway: On or about April 13, 2021 and times prior, employees used a metal platform to work from and travel to separate scaffold tiers.  The metal platform was approximately 12 inches wide exposing employees to a fall of approximately 20 feet.   d) Top Werner walkway: On or about April 13, 2021 and times prior, employees used a metal platform to work from and travel to separate scaffold tiers.  The metal platform was approximately 12 inches wide exposing employees to a fall of approximately 30 feet.

29 CFR  1926.451(e)(1):When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  a) On April 13, 2021, and times prior, employees were working from scaffolding that did not have access to all levels through the prefabricated ladder system and no other adequate means of access were used.  Employees did not use ladders but used hand holds that were located on the side of the walkthrough scaffold to gain access to the first level which was approximately 8 feet above ground.

29 CFR  1926.452(c)(4):End frames of tubular welded frame scaffolding were not locked together vertically by use of pins or equivalent means in areas where uplift could occur:  a) On or about April 13, 2021 and times prior, employees used a fabricated frame scaffold with 5 vertical levels to perform pressure washing and painting operations. The ends of the scaffold frames were not locked together by use of pins exposing the scaffold to potential uplifts during high wind conditions when employees are working.
