29 CFR  1926.150(a)(1):  The employer did not develop and maintain a fire protection program to be followed throughout all phases of construction and demolition work, and did not provide for the firefighting equipment as specified in this subpart:  a) Smyrna/Lepsic Road Bridge #BR2-012C over Delaware Route 1 Southbound Lanes Smyrna, DE 19977: On or about April 13, 2021, The employer did not provide nor was the Foreman able to acknowledge there was a fire protection program on site where employees worked with flammable materials including but not limited to gasoline, wood, paper and ignition sources were present including but not limited to heat and spark producing equipment, compromised electrical components provide any type of fire protection program to ensure that proper fire protection was addressed and the employees knew what to do in the event of a fire.

29 CFR  1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail and one stair rail system along each unprotected side or edge:  a) Smyrna/Lepsic Road Bridge #BR2-012C over Delaware Route 1 Southbound Lanes Smyrna, DE 19977: On or about April 13, 2021, employees were required to use a stairway to access the shower area that did not have any type of handrail in place.  The stairs consisted of four risers and more than forty inches above ground to access the vehicles floor.  If an employee needed to access the trailer they were subject to hazards of falling from the stairs.
