29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) On or about 4/7/2021 at a commercial new build located at 1111 Elmwood Avenue, Buffalo, New York; employees were framing and sheathing a 4 story building. Employees were framing and sheathing exterior walls and openings on the 2nd and 3rd floors with a fall height of approximately 20 to 30 feet. There were no fall protection measures in place. NO ABATEMENT CERTIFICATION REQUIRED R. Gingerich Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.501(b)(1)), which was contained in OSHA inspection number 1423913, citation number 1, item number 1 and was affirmed as a final order on 10/11/2019, with respect to a workplace located at 1111 Elmwood Avenue, Buffalo, New York.
