29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds were not fully planked or decked between the front uprights and the guardrail supports: (a) Lead King Custom Homes, Inc. dba Lead King Construction at 431 W. Hallam St., Aspen, CO 81611: On or before April 12, 2021 the exposing and correcting employer did not protect employees from injury, in that an employee installing siding worked from a fabricated scaffold without the working level fully planked. This condition exposed the employee to a fall hazard of approximately 8 feet.

29 CFR 1926.451(f)(7): Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person. (a) Lead King Custom Homes, Inc. dba Lead King Construction at 431 W. Hallam St., Aspen, CO 81611: On or before April 12, 2021 the exposing and correcting employer did not ensure a fabricated frame scaffold was erected with the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling, or alteration. An employee installing siding worked from a fabricated scaffold without the working level fully planked. The employee also stood on the integrated ladder located at the side of the scaffold and not from the planking in-between the uprights. This condition exposed the employee to a fall hazard of approximately 8 feet.

29 CFR 1926.454(a): The employer did not have each employee who performs work while on a scaffold(s) trained by a person qualified in the subject matter to recognize those hazards associated with the type of scaffold(s) being used and to understand the procedure(s) to control or minimize those hazards: (a) Lead King Custom Homes, Inc. dba Lead King Construction at 431 W. Hallam St., Aspen, CO 81611: On or before April 12, 2021 the exposing and correcting employer did not have each employee who performs work while on a scaffold(s) trained by a person qualified in the subject matter to recognize those hazards associated with the type of scaffold(s) being used and to understand the procedure(s) to control or minimize those hazards. An employee installing siding worked from a fabricated scaffold without the working level fully planked. The employee also stood on the integrated ladder located at the side of the scaffold and not from the planking in-between the uprights. This condition exposed the employee to a fall hazard of approximately 8 feet. Abatement Note: The training shall include the following elements at a minimum: 1. The nature of any electrical hazards, fall hazards, and falling object hazards in the work area; 2. The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used: 3. The proper use of the scaffold, and the proper handling of materials on the scaffold; 4. The maximum intended load and the load-carrying capacities of the scaffold used; and 5. Any other pertinent requirements of this subpart.

Hallam St., Aspen, CO 81611: On or before April 12, 2021 the exposing and correcting employer did not ensure employees were protected from injury in that, an employee did not utilize a fall protection system when he accessed the fabricated frame scaffold that was setup on the second level of the residential building. This condition exposed an employee to a fall hazard of approximately 10 feet to the ground below. (b) Lead King Custom Homes, Inc. dba Lead King Construction at 431 W. Hallam St., Aspen, CO 81611: On or before April 12, 2021 the exposing and correcting employer did not ensure employees were protected from injury in that, employees did not utilize a fall protection system when installing siding and roofing materials while working on the second level of the residential building. An employee fell off the edge of the second level and sustained serious injuries. This condition exposed employees to a fall hazard of approximately 10 feet to the ground below.
