29 CFR 1926.20(b)(2):  The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of job-sites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):  (a)	Brikor Associates, Inc. at 431 W. Hallam Street, Aspen, CO 81611:  On and before April 12, 2021 the controlling employer did not ensure that subcontractor employees were protected from injury, in that a subcontractor employee installing siding worked from a fabricated scaffold without the working level fully planked.  The employee also stood on the integrated ladder located at the side of the scaffold and not from the planking in-between the uprights.  This condition exposed the subcontractor employee to a fall hazard of approximately 8 feet.  (b)	Brikor Associates, Inc. at 431 W. Hallam Street, Aspen, CO 81611:  On and before April 12, 2021 the controlling employer did not ensure that subcontractor employees were protected from injury, in that a subcontractor employee did not utilize a fall protection system when he accessed the fabricated frame scaffold that was setup on the second level of the residential building.  This condition exposed the subcontractor employee to a fall hazard of approximately 10 feet to the ground below.  (c)	Brikor Associates, Inc. at 431 W. Hallam Street, Aspen, CO 81611:  On and before April 12, 2021 the controlling employer did not ensure that subcontractor employees were protected from injury, in that subcontractor employees did not utilize a fall protection system while installing siding and roofing materials while working on the second level of the residential building.  A subcontractor employee fell off the edge of the second level and sustained serious injuries.  This condition exposed subcontractor employees to a fall hazard of approximately 10 feet to the ground below.  Abatement Note:  OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.
