29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor was an alternative fall protection measure provided: (a)Oscar Mendez Diaz at 5000 South Bahnson Avenue, Sioux Falls, SD 57103: On or about and at times prior to April 11, 2021, the exposing employer did not ensure employees were protected from falls while conducting roofing operations on a 4-in-12 pitch apartment complex. Employees were installing roofing materials on a three-story multi-family residential project with no fall protection systems in place. This condition exposed employees to fall hazards of greater than 30 feet.

29 CFR 1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a)Oscar Mendez Diaz at 5000 South Bahnson Avenue, Sioux Falls, SD 57103: On or about and at times prior to April 11, 2021, the exposing employer did not ensure that each employee engaged in roofing operations were trained to recognize the hazards of working at elevation and trained in the use of fall protection. Employees were engaged in roofing activities near the edge of the roof of a 4-in-12 pitch, three-story multi-family residential project, without the use of a fall protection system. This condition exposed employees to fall hazards greater than 30 feet. Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas: a) The nature of fall hazards in the work area; b) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; c) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; d) The role of each employee in the safety monitoring system when this system is used; e) The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; f) The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and g) The role of employees in fall protection plans; h) The standards contained in this subpart. Abatement Note: 1926.503(b)(1) provides that the employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.
