29 CFR 1910.147(c)(4)(i):Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: (a) BRENNTAG NORTHEAST FACILITY, TANK FARM PROJECT - Employee(s) performed work to modify the wiring and electrical components of the formic acid system in the tank farm project, and the employee(s) had not taken steps to ensure that they were protected from residual acid that remained in the piping system. This resulted in the employee having been sprayed with formic acid and sustaining severe chemical burns, on or about April 7, 2021. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.147(f)(2)(i):When outside servicing personnel were engaged in activities in a facility, the onsite employer and the outside employer did not inform each other of their respective lockout or tagout procedures: (a) BRENNTAG NORTHEAST FACILITY, TANK FARM PROJECT - Employee(s) performed work to modify the wiring and electrical components of the formic acid system in the tank farm project owned by the onsite employer, Brenntag Northeast LLC. The employer had not obtained the energy control procedures for the piping system from the host employer, nor had they discussed their own energy control procedures with the host employer, on or about April 7, 2021. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
