29 CFR 1910.147(c)(4)(i):Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: (a) BRENNTAG NORTHEAST FACILITY, TANK FARM PROJECT - Outside contractor employee(s) performed work to modify the wiring and electrical components of the formic acid system in the tank farm project, and the employer had not developed energy control procedures for the formic acid system that these workers were performing work on, on or about April 7, 2021. (b) BRENNTAG NORTHEAST FACILITY, TANK FARM PROJECT - Brenntag Northeast LLC employee(s) performed maintenance on the piping systems in the tank farm project, and the employer had not developed energy control procedures for the various systems located in the tank farm project, on or about April 7, 2021. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

1910.147(d)(5)(ii) Where there was a possibility of re-accumulation of stored energy to a hazardous level, verification of isolation was not continued until the servicing or maintenance was completed, or until the possibility of such accumulation: (a) BRENNTAG NORTHEAST FACILITY, TANK FARM PROJECT - Employee(s) of an outside contractor performed work to modify the wiring and electrical components of the formic acid system in the tank farm project owned by the onsite employer. The onsite employer had not provided the energy control procedures for the piping system to the outside contractor, nor had they requested the details of the outside employer's energy control program, on or about April 7, 2021. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
