29 CFR  1926.150(a)(1): The employer did not develop and maintain a fire protection program to be followed throughout all phases of construction and demolition work, and/or did not provide for the firefighting equipment as specified in this subpart:  a) 511 Collins Ave, Hasbrouck Heights NJ - The employer did not provide any firefighting equipment at the jobsite. A gasoline fueled compressor was used on site to power a nail gun to secure shingles to the roof.  Extra gasoline was stored in a gas can on site on or about April 14,2021.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) 511 Collins Ave, Hasbrouck Heights NJ / Exterior - Employees engaged in residential construction 6 feet or more above lower levels were not protected by any method of fall protection. Three employees were exposed to fall hazards of approximately 23 feet while working on the roof, on or about April 14, 2021.   Falcon Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13) , which was contained in OSHA inspection number 1318374, citation number 2, item number 1  and was affirmed as a final order on 11/5/18, with respect to a workplace located at 179 East Main Street, Bergenfield NJ 07621.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a) 551 Collins Avenue Hasbrouck Heights NJ - Exterior/Rear-  A portable ladder was used for access by employees to an upper landing surface that did not have the ladder rails extend at least 3 feet above the upper landing surface. Employees were observed accessing a residential roof by using a portable ladder that did not have the rails extended at least 3 feet above the upper landing surface, on or about April 14, 2021.  The Falcon Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1318374 , citation number 2 , item number 1 and was affirmed as a final order on 11/5/2018, with respect to a workplace located at 179 East Main Street, Bergenfield NJ 07621.

The Falcon Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1) ,which was contained in OSHA inspection number 1312073, citation number 1 , item number 1 and was affirmed as a final order on 11/2/18, with respect to a workplace located at 640 Summit Avenue Hackensack NJ 07601.
