Containers in storage shall be located so as to minimize exposure to excessive temperature rise, physical damage, or tampering by unauthorized persons.  a) On or around April 29, 2021, three propane tanks that were used to fuel forklifts were stored outside near the back entrance at the bottom of the loading ramp and exposed to vehicular traffic.

29 CFR  1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training, and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup, or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.  a) On or around April 19, 2021, the employer did not have an energy control program that included specific energy isolation procedures, training for authorized, affected, and other employees, and periodic inspections of the procedures on an annual basis for equipment such as but not limited to; the two Renegade Bridge saws.

Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly.    a) On or before April 19, 2021, the employer did not obtain the manufacturers prior written approval when the boom attachment used to move granite slabs was added to the Red Toyota forklift.

When a powered industrial truck is left unattended, load engaging means shall be fully lowered, controls shall be neutralized, power shall be shut off, and brakes set. Wheels shall be blocked if the truck is parked on an incline.  a) On or before April 19, 2021, the Red Toyota forklift was left unattended with the forks left in an elevated position with an extension boom attached.

One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips, and sparks. Examples of guarding methods are barrier guards, two-hand tripping devices, electronic safety devices, etc.  a) On or about April 19, 2021,  the two Renegade bridge saws did not utilize a guarding method that would prevent employees from getting caught in the moving 14" circular saw and struck by the bridge the saw was mounted to.

29 CFR  1910.243(c)(3): Portable abrasive wheels -Vertical portable grinders. Safety guards used on machines known as right angle head or vertical portable grinders shall have a maximum exposure angle of 180 deg., and the guard shall be so located so as to be between the operator and the wheel during use. Adjustment of guard shall be such that pieces of an accidentally broken wheel will be deflected away from the operator.  a) On or around April 19, 2021, the handheld electric powered Makita angle grinders used to cut stone did not have a guard on the grinding wheel.

29 CFR  1910.305(j)(1)(i):Fixtures, lampholders, lamps, rosettes, and receptacles may have no live parts normally exposed to employee contact. However, rosettes and cleat-type lampholders and receptacles located at least 2.44 m (8.0 ft) above the floor may have exposed terminals.  a) On or before April 19, 2021, the junction box that could hold four receptacles located in the wet cutting area on the wall behind the table had exposed live wires on the left side.
