29 CFR 1910.146(d)(3)(iv): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement the means, procedures, and practices necessary for safe permit entry operations by purging, inerting, flushing or ventilating the permit space as necessary to eliminate or control atmospheric hazards. On or about 04/13/2021, at the Atlantic Sapphire Salmon Farm, 22275 SW 272 Street, Homestead, Florida 33031, the (host) employer (Atlantic Sapphire) did not implement a permit-required confined space for contractor (P & P Service Group, LLC) to work in a permit-required confined space (salmon tank) without implementing procedures and practices necessary to eliminate or control atmospheric hazards exposing the employees to asphyxiation hazards.

29 CFR 1910.146(c)(8)(i): When an employer arranged to have employees of another employer (contractor) perform work that involved permit space entry, the host employer did not inform the contractor that the workplace contained permit spaces and did not ensure that permit space entry was only allowed through compliance with a permit space program meeting the requirements of this section: On or about 04/13/2021, at the Atlantic Sapphire Salmon Farm, 22275 SW 272 Street, Homestead, Florida 33031, the (host) employer (Atlantic Sapphire) did not inform contractor that the workplace contained workplace hazards that involved a permit-required confined space (salmon tank) and the requirements to comply with a confined space program.
