29 CFR 1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about April 18, 2021 employees performing construction work around the tunnel at the commodity barn were exposed to fall hazards because they were not provided guardrail systems, safety net systems, or personal fall arrest systems.

29 CFR 1904.39(a)(1):The employer did not report within 8-hours the death of an employee resulting from a work-related incident On April 18, 2021 at approximately 9:30am, an employee performing construction work fell and died. The fatality was not reported within 8 hours to the local Area Offices of the Occupational Safety and Health Administration. The fatality was reported by phone on April 19, 2021 at approximately 11:00am.
