29 CFR 1910.27(a): The employer did not ensure that scaffolds used in general industry meet the requirements in 29 CFR part 1926, subpart L) In the alternative 1926.451(e)(8): Direct access to or from another surface shall be used only when the scaffold is not more than 14 inches (36 cm) horizontally and not more than 24 inches (61 cm) vertically from the other surface.  a. 100 Raskulinecz Rd., Carteret, NJ  The employer did not ensure that employees accessing a mobile scaffold were less than 24 inches vertically from the other surface.  An employee engaged in maintenance activities used a scissor lift to access the roof which was more than 24 inches from the roof line to which the employee climbed the guardrails as a means of access.    Violation observed on or about April 21, 2021

29 CFR 1910.28(b)(1)(i):  Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  a. 100 Raskulinecz Rd., Carteret, NJ  The employer did not ensure that unprotected walking-working surfaces provided protection from falls.  An employee engaged in building maintenance activities use a scissor lift to access a roof and walked across the roof without guardrails or any other means of fall protection.   Violation observed on or about April 12, 2021

29 CFR 1910.147(a)(2)(ii): Alternative measures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by the exception of 1910.147(a)(2)(ii) for routine, repetitive, and integral processes such as minor tool changes and adjustments, and other minor servicing activities.  a. 100 Raskulinecz Rd., Carteret, NJ - Production Area  The employer did not ensure alternative procedures were developed for the control of potentially hazardous energy.  Employees engaged in the packaging of food products replaced packaging film on Repak, RE20 machines using only the "stop" button to pause the machine and/or did not stop the machine when replacing packaging film, where employees did not have direct control at the "stop" button and no procedures for stopping the machine were developed to protected employees from the hazardous energy.   Violation occurred on or about April 21, 2021

29 CFR  1910.219(f)(3):Sprocket wheels and chains which were seven (7) feet or less above floors or platforms were not enclosed:  a. 100 Raskulinecz Rd., Carteret, NJ  The employer did not ensure that chains and sprockets were protected.  Employees engaged in the production of food products operated Repak, RE20 packaging machines that did not have cover plates over the sprockets and chains where the employees loaded the packaging product film.
