29 CFR 1910.303(b)(8)(i): Electric equipment shall be firmly secured to the surface on which it is mounted. Note to paragraph (b)(8)(i) of this section: Wooden plugs driven into holes in masonry, concrete, plaster, or similar materials are not considered secure means of fastening electric equipment. a) On or about April 21, 2021, four wound transformers (AKA current loop transformers) with exposed conductors carrying alternating current at 130 volts and 37 amps at each transformer were setting unsecured on top of an unsecured rolling cart. b) On or about April 21, 2021, three 15 amp fuses and three 4 amp fuses with exposed conductors were secured to a piece of wooden board which was placed unsecured on top of an unsecured rolling board on the floor. There was alternating current at 37 amps and 208 volts going into the fuses. c) On or about April 21, 2021, three enclosures used to divide the wiring into 3 phases from a plug-in receptacle carrying alternating current at 37 amps and 208 volts were placed onto an unsecured wooden board.

29 CFR 1910.303(g)(2)(i): Except as�elsewhere required�or permitted�by this�standard, live�parts of�electric equipment�operating at�50 volts�or more�shall be�guarded against�accidental contact by�use of�approved cabinets�or other�forms of�approved enclosures�or by�any of�the following�means: (g)(2)(i)(A) By location in a room, vault, or similar enclosure that is accessible only to qualified persons; (g)(2)(i)(B) By suitable permanent, substantial partitions or screens so arranged so that only qualified persons will have access to the space within reach of the live parts. Any openings in such partitions or screens shall be so sized and located that persons are not likely to come into accidental contact with the live parts or to bring conducting objects into contact with them; (g)(2)(i)(C) By placement on a suitable balcony, gallery, or platform so elevated and otherwise located as to prevent access by unqualified persons; or (g)(2)(i)(D) By elevation of 2.44 m (8.0 ft) or more above the floor or other working surface. a) On or about April 21, 2021 in the ESS lab, four wound transformers (AKA current loop transformers) with exposed conductors carrying alternating current at 130 volts and 37 amps were not guarded against accidental contact. b) On or about April 21, 2021 in the ESS lab, three 15 amp fuses and three 4 amp fuses with exposed conductors carrying alternating current at 130 volts and 37 amps were not guarded against accidental contact. c) On or about April 21, 2021 in the ESS lab, three enclosures used to divide the wiring into 3 phases from a plug-in receptacle carrying alternating current at 37 amps and 208 volts had exposed wires that were not guarded against accidental contact. d) On or about April 21, 2021 in the ESS lab, the enclosure on the left side of the Blue M oven had an open bottom with exposed electrical conductors carrying alternating current at 130 volts and 25 amps that were not guarded against accidental contact.

1910.305(g)(1)(iv) Unless specifically permitted otherwise in paragraph (g)(1)(ii) of this section, flexible cords and cables may not be used: (g)(1)(iv)(A): As a substitute for the fixed wiring of a structure. a) On or about April 21, 2021, the employer did not ensure that flexible cords and cables were not used as fixed wiring in that the employer's disconnect which powered their Cincinnati Sub Zero Oven in the ESS Lab was powered at 240 volts using flexible cables in place of fixed wiring. b) On or about April 21, 2021, the employer did not ensure that flexible cords and cables were no used as fixed wiring in that the silver metal enclosure on the left side of the Blue M Oven in the ESS lab was wired was powered at 130 volts using a flexible cord that was plugged into an outlet in place of fixed wiring.

Qualified persons (i.e. those permitted to work on or near exposed energized parts) shall, at a minimum, be trained in and familiar with the following: (b)(3)(i) The skills and techniques necessary to distinguish exposed live parts from other parts of electric equipment. (b)(3)(ii) The skills and techniques necessary to determine the nominal voltage of exposed live parts, and (b)(3)(iii) The clearance distances specified in 1910.333(c) and the corresponding voltages to which the qualified person will be exposed. a) On or about April 21, 2021, employees working in the ESS Lab, performing tests such as but not limited to the inline fused burn in test for the EMI filter, were not trained in and familiar with electrical safety-related work practices such as but not limited to when to wear personal protective equipment, how to inspect personal protective equipment, safe working distances on energized equipment, and how to verify that the electrical current has been deenergized.

29 CFR 1910.333(b)(2)(iv)(B): A qualified person shall use test equipment to test the circuit elements and electrical parts of equipment to which employees will be exposed and shall verify that the circuit elements and equipment parts are deenergized. The test shall also determine if any energized condition exists as a result of inadvertently induced voltage or unrelated voltage backfeed even though specific parts of the circuit have been deenergized and presumed to be safe. If the circuit to be tested is over 600 volts, nominal, the test equipment shall be checked for proper operation immediately after this test. a) On or about April 21, 2021 during the inline fused burn in test for the EMI filter, the employer did not perform electrical testing prior to plugging in the testing unit. When plugging in the testing unit, employees stood within inches of exposed conductors and turned on electrical testing equipment which was attached to exposed conductors located at the transformers. The electrical conductors were carrying alternating current at 208 volts and 35 amps.

Note: Personal protective equipment requirements are contained in subpart I of this part. a) On or about April 21, 2021, employees working the ESS Lab, performing tests such as but not limited to the inline fused burn in test for the EMI filter, were not wearing electrical personal protective equipment when working near parts energized at less than 440 volts, when plugging in the power to perform tests, and turning on the electrical meters.
