OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards associated with being struck by a reversing garbage truck:  a. On or about April 6, 2021, and at times prior, an employee performing garbage collection exterior to the rear of the Hino/E-Z Pack rear-loading garbage truck/trailer was exposed to struck-by and crushed-by hazards associated with the reversing vehicle.  The vehicle's audible back-up alarm, rear camera system, and exterior rear lighting were not functional.   The employee exterior to the vehicle was not wearing high-visibility vest/clothing.

29 CFR  1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:  a. On or about April 22, 2021, and at times prior, the employer did develop and implement a hazard communication program associated with the hazardous chemicals utilized at the work site such as, but not limited to, diesel fuel, exhaust fluids, and truck oil.

29 CFR  1910.1200(g)(1): Chemical manufacturers and importers shall obtain or develop a safety data sheet for each hazardous chemical they produce or import. Employers shall have a safety data sheet in the workplace for each hazardous chemical which they use.  a. On or about April 22, 2021, and at times prior, the employer did not obtain a safety data sheet for each hazardous chemical which they utilized. Hazardous chemicals utilized included, but were not limited to, diesel fuel, exhaust fluids, and truck oil.

29 CFR  1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  a. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.  a.
