OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards associated with being struck by a reversing garbage truck: a. On or about April 6, 2021, and at times prior, an employee performing garbage collection exterior to the rear of the Hino/E-Z Pack rear-loading garbage truck/trailer was exposed to struck-by and crushed-by hazards associated with the reversing vehicle. The vehicle's audible back-up alarm, rear camera system, and exterior rear lighting were not functional. The employee exterior to the vehicle was not wearing high-visibility vest/clothing.
