29 CFR 1910.28(b)(1)(i): 29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): On or about April 23, 2021, an employee was exposed to a fall of approximately 15 feet while performing unloading of chlorine from a train tanker. The employee would stand on the top of the tanker platform with guardrail system that was missing a mid rail and the employer did not ensure that he was properly protected from the fall.

29 CFR 1910.30(a)(1):29 CFR 1910.30(a)(1): The employer did not provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart before any employee is exposed to a fall hazard. And/or the employer did not ensure employees are trained in the requirements of this paragraph on or before May 17, 2017. On or about April 23, 2021, an employee was exposed to a fall of approximately 15 feet while performing unloading of chlorine from a train tanker. The employee would stand on the top of the tanker platform with guardrail system that was missing a mid rail and the employer did not ensure that he was trained on how to properly use fall protection.

The employee had operated the fork lift for approximately 3 months and the employer did not ensure that he had successfully completed a training program in safe operation.

An employee had a near miss accident on 4/5/21 and the employer did not ensure that he was given refresher training before he continued operating the lift.
