29 CFR 1904.39(a)(1):Basic Requirement. Within eight (8) hours after the death of any employee as a result of a work-related incident, you must report the fatality to the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor. On or about April 22, 2021, it was reported to the employer that an employee injured in a work place accident had passed away. The employer failed to report the fatality to the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor within eight (8) hours. Abatement certification is required of this item in accordance with requirements of 29 CFR 1903.19(c).

29 CFR 1904.39(a)(2):Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. On or about April 7, 2021, an employee reported that they had been involved a work place accident that resulted in a hospitalization. The employer failed to report the hospitalization to the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor within twenty-four (24) hours. Abatement certification is required of this item in accordance with requirements of 29 CFR 1903.19(c).
