(a)   At the Coley Gin & Fertilizer Co. - On or about April 22, 2021, the employer did not ensure the use of head protection by employees who were lifting metal decking and machinery overhead, thereby exposing employees to head injuries.

29 CFR  1926.451(c)(2)(iv):Front-end loaders and similar pieces of equipment were used to support scaffold platforms without being specifically designed by the manufacturer for such use.  (a) At the 1st stage cleaning/Overhead Incline Cleaner - On or about April 22, 2021, employees engaged in construction activities we required to work from an elevated position. The employer used an unauthorized metal basket, not designed by a manufacturer, to elevate the employees, thereby exposing employees to fall hazards and struck-by injuries.

29 CFR  1926.451(c)(2)(v):Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied.  (a) At the 1st stage cleaning/Overhead Incline Cleaner - On or about April 22, 2021, employees engaged in construction activities we required to work from an elevated position. The employer required the use of a metal basket as a scaffold that was not attached to the forklift, thereby exposing employees to fall and  struck-by hazards.

29 CFR  1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  (a) At the 2nd stage cleaning area - On or about April 22, 2021,the employer did not ensure the use of fall protection for employees working on an elevated platform greater than six feet, thereby exposing employees to a fall hazard.

29 CFR  1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury.  (a) At the Coley Gin & Fertilizer Co. - On or about April 22, 2021, the employer did not train each employee exposed to various hazards associated with construction on how to recognize and minimize these hazards, thus exposing employees to various hazard such as: 1) Employees were not directed to wear hardhats. 2) Employees were not trained to the requirements for fall protection. 3) Employees were not trained on the requirements for baskets used with forklifts.  4) Employees were not trained on the requirements for rigging operations.  5) Employees were not informed of the requirement for fall protection inside an aerial lift.
